This Privacy Policy explains how Danphe Finance and the parties identified in the Credit Guide collect, use, disclose, store and protect personal information.

Who We Are

“We”, “us” and “our” refers to the Broker, Aggregator, Australian Credit Licensee and our related businesses outlined in the Credit Guide provided to you.

Our Commitment to Protect Your Privacy

We understand how important it is to protect your personal information. This document sets out our privacy policy commitment in respect of personal information we hold about you and what we do with that information.

We recognise that any personal information we collect about you will only be used for the purposes for which we collected it or as otherwise permitted by law. It is important to us that you are confident that any personal information we hold about you will be treated in a way that protects that information.

Our commitment is to comply with the Australian Privacy Principles contained in the Privacy Act and any other relevant law.

Personal Information

When we refer to personal information, we mean information or an opinion from which your identity is reasonably apparent. The personal information we hold about you may also include credit information.

Credit information is information used to assess your eligibility to be provided with finance. It may include information about finance you have outstanding, your repayment history and any defaults. Credit information is commonly exchanged between credit providers, finance providers and credit reporting bodies.

The kinds of personal information we may collect include:

  • Your name, date of birth and address
  • Your telephone number, email address and other contact details
  • Account details and occupation
  • Information needed to verify your identity
  • The type and amount of finance you are interested in obtaining
  • Information provided directly through our website or indirectly through your use of it
  • The ages and number of your dependants and cohabitants
  • Your residential history and length of time at your current address
  • Employment details and evidence of earnings and expenses

If you apply for an insurance product through us, we may also collect health information. We will only collect health information with your consent.

Why We Collect Your Personal Information

We collect personal information for the purposes of assessing your application for finance and managing that finance.

We may also collect personal information for direct marketing and for managing our relationship with you. From time to time, we may offer other products and services.

We collect personal information through our website to send communications requested by you, answer enquiries and provide information or advice.

To maintain a successful business relationship with you, we may disclose personal information to other organisations that provide products or services used or marketed by us. We may also disclose your information to an organisation that has or is considering having an interest in your finance or in our business.

How We Collect Your Personal Information

Where reasonable and practical, we will collect your personal information directly from you.

We may also collect personal information from LM Broker Services, other finance brokers and other people or organisations such as accountants and lawyers.

Do We Disclose Your Personal Information?

We may disclose your personal information:

  • To prospective funders or other intermediaries in relation to your finance requirements
  • To organisations involved in managing or administering your finance
  • To third-party suppliers, printing and postal services and call centres
  • To associated businesses that may wish to market products to you
  • To companies that provide information and infrastructure systems to us
  • To anybody who represents you, including finance brokers, lawyers and accountants
  • To anyone where you have provided consent
  • Where required by law, including under the Anti-Money Laundering and Counter-Terrorism Financing Act 2006 (Cth)
  • To investors, agents, advisers or entities that have an interest in our business
  • To your employer, referees or identity-verification services

Before disclosing personal information to another person or organisation, we will take reasonable steps to satisfy ourselves that:

  • The person or organisation has a commitment to protecting your personal information that is at least equal to our commitment; or
  • You have consented to the disclosure.

Do We Disclose Your Personal Information Outside Australia?

We may disclose personal information to related bodies corporate and third-party suppliers or service providers located overseas for some of the purposes described above.

We take reasonable steps to ensure overseas recipients do not breach privacy obligations relating to your personal information.

Overseas recipients may include:

  • Data-hosting and other IT service providers located in various countries
  • Other third parties located in foreign countries, including the Philippines and the United States of America

Your personal information may also be stored in cloud services in overseas countries. If stored in this way, disclosures may occur in countries other than those listed above.

Information disclosed overseas may be subject to foreign law and may not receive the same protection as information handled under the Australian Privacy Principles. By providing your details, you consent to your information being disclosed in this manner.

Direct Marketing

From time to time, we may use your personal information to provide current information about finance, offers you may find of interest, changes to our organisation or new products and services offered by us or an associated company.

You may opt out of receiving marketing information at any time by contacting us. Where marketing is sent by email, you may also use the unsubscribe function.

We will not charge you for giving effect to your opt-out request and will take reasonable steps to action your request as soon as practicable.

Updating Your Personal Information

We rely on personal information being accurate, complete and current. You should notify us when your details change or when you become aware that information we hold is incorrect or out of date.

You may contact us at any time to request that your information be updated.

Access and Correction of Your Personal Information

You may request access to personal information we hold about you at any time. We may charge a fee for the reasonable costs of retrieving and supplying the information.

Depending on the type of request, we may respond immediately. Otherwise, we will generally provide an initial response within seven days. We may need to contact other entities to investigate your request properly.

There may be situations where we are not required to provide access, including where information relates to existing or anticipated legal proceedings or where a request is vexatious. If access is denied, we will explain the reason.

If personal information we hold is incorrect, inaccurate or out of date, you may request correction. Where appropriate, we will correct the information.

We will generally provide an initial response within seven days and, where reasonable, provide details about whether the information has been corrected within 30 days. We may need to consult with other entities during our investigation.

If we refuse to correct personal information, we will provide our reasons.

Using Government Identifiers

If we collect government identifiers, such as a tax file number, we will not use or disclose that information except where required or permitted by law.

We will not use a government identifier as our own means of identifying you.

Doing Business Without Identifying You

In most circumstances, it will be necessary for us to identify you in order to do business with you successfully.

Where it is lawful and practicable, we will provide an opportunity to deal with us without providing personal information. For example, you may make a general enquiry about interest rates or promotional offers without identifying yourself.

Sensitive Information

We will only collect sensitive information with your consent.

Sensitive information includes information relating to racial or ethnic origin, political opinions, membership of political, trade or professional associations, trade-union membership, sexual preferences, criminal record or health.

How Safe and Secure Is Your Personal Information?

We take reasonable steps to protect personal information by storing it in a secure environment. Personal information may be stored in paper or electronic form.

We also take reasonable steps to protect personal information from misuse, loss, unauthorised access, modification and disclosure.

Privacy Complaints

If you are dissatisfied with how we have handled your personal information or believe we have not complied with the Privacy Act, you may contact us through the contact page.

We will acknowledge your complaint within seven days and provide a decision within 30 days.

If you are dissatisfied with the response, you may complain to the Office of the Australian Information Commissioner.
